These Terms of Service (also referred to as this "End-User License Agreement" or "EULA," and collectively, these "Terms") govern your use of the LifeLyt mobile application and related services (the "Service"). By creating an account, tapping "I agree," or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

The Service is operated by LifeLyt ("LifeLyt," "we," "our," or "us"). References to "you" mean the individual who creates or uses an account.

2. The Service

LifeLyt is a memory-resurfacing application. It lets you sign in, connect cloud photo and check-in services you already use, and surface photos from this day in previous years. The Service stores your account profile, your reactions and notes, and a short-lived daily cache of today's matching photos. We do not upload or copy the contents of your photo library to our servers.

3. Accounts

3.1 Eligibility

You must be at least 13 years old (or older, where local law requires a higher minimum) to use the Service. By creating an account you represent that you meet this requirement.

3.2 Registration & authentication

You may sign in using your phone number, your Google account, or your Apple ID. We use Firebase Authentication to verify your identity and to issue you a unique user identifier. You agree that the information you provide during sign-in is accurate and that you will keep it up to date.

3.3 Account security

You are responsible for keeping your device, your phone, and any third-party sign-in credentials secure. We are not liable for losses caused by unauthorized access where you have not taken reasonable steps to protect your device or credentials. 3.4 Account deletion

You may delete your account at any time from Settings → Account → Delete Account, or by emailing us. Deletion is permanent, as described in our Privacy Policy, §10.

4. License & Acceptable Use

4.1 License grant

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the LifeLyt mobile application on devices you own or control.

4.2 Restrictions

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent this restriction is prohibited by applicable law.
• Modify, translate, or create derivative works of the Service.
• Use the Service to build a competing product or to train a machine-learning model.
• Use automated tools, bots, scrapers, or scripts to access the Service except for our published APIs.
• Attempt to gain unauthorized access to the Service, to other users' data, or to our infrastructure.
• Bypass or attempt to bypass App Check, rate limits, or any security measure.
• Use the Service for any unlawful purpose, or to violate the rights of any third party.
• Upload or transmit viruses, malware, or anything intended to disrupt the Service.

4.3 Suspension & termination

We may suspend or terminate your account or access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if continued provision of the Service would create a security or legal risk, or if we discontinue the Service.

5. Connected Third-Party Services

The Service integrates with third-party platforms including Facebook (Meta), Google Photos, Dropbox, Foursquare Swarm, Tumblr, and Flickr. When you connect one of these services you authorize us to access your content on that service as described in our Privacy Policy. Each platform's own terms and privacy policy continue to govern data held by that platform. You may disconnect a service at any time from Settings → Connected Accounts; doing so deletes the encrypted refresh token and stops future fetches.

6. Subscriptions (LifeLyt Pro)

LifeLyt may offer optional paid features under the brand "LifeLyt Pro." By purchasing a subscription you agree to the following:

• Billing. Subscriptions are billed through the Apple App Store or Google Play Store under your platform account. Payment, renewal, and refund handling are governed by that store's policies.
• Auto-renewal. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can cancel from your store's subscription settings.
• Free trial. If a free trial is offered, you will not be charged during the trial. If you do not cancel before the trial ends, you will be charged the subscription fee.
• Price changes. We may change subscription prices prospectively, with reasonable notice. Continued use after a price change constitutes acceptance.
• No refunds from LifeLyt. Except where required by law, subscription fees are non-refundable by LifeLyt. Refund requests are handled by Apple or Google per their respective policies.

7. Intellectual Property

The Service, including its design, code, trademarks, logo, and content we provide (other than your content), is owned by LifeLyt or its licensors and is protected by intellectual-property laws. You retain ownership of any content you import through the Service (your photos, journal entries, and reactions). You grant us a limited license to host, transmit, and display that content solely to operate the Service for you.

8. Feedback

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use that feedback to improve the Service without obligation to you.

9. Disclaimers & No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL ALWAYS BE AVAILABLE. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFELYT AND ITS OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).

11. Indemnification

You agree to indemnify and hold harmless LifeLyt and its officers, employees, and licensors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any third party's rights.

12. Changes to these Terms

We may update these Terms from time to time. For material changes — for example, a new paid feature, a change to data practices, or a change to dispute resolution — we will give you at least 30 days' notice through the app and by email (if we have one). The "Last updated" date at the top of these Terms reflects the most recent revision. Continued use of the Service after the effective date of a change constitutes acceptance.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits your right to bring a claim in your local court where required by consumer-protection law.

14. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and LifeLyt regarding the Service.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
• No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
